1. Summary

These Terms and Conditions describe the policies of Maverick Diagnostics Ltd. (hereinafter referred to as “Maverick”) for supplying goods and services. These terms govern all contractual relations between Maverick and any person or entity (hereinafter referred to as “Customer”) purchasing from Maverick to the exclusion of any terms contained in any Customer’s documents, even if the Customer’s terms purport to prevail.

No employees or persons acting on behalf of Maverick are authorised to agree to any alterations to these terms or make representations or warranties regarding the goods or services, except where expressly agreed in writing by a Director of Maverick.

 

2. Registration Process

The responsibility for completing the vehicle manufacturer diagnostic registration process lies solely with the Customer. Maverick will assist by providing written guides and over-the-phone consultations. Please note that vehicle manufacturers may alter their registration processes without notice. Maverick endeavours to keep guidance up to date but is not liable for any discrepancies.

Timely completion of the registration process is critical, and it is the Customer’s responsibility to regularly check their inbox during the application stages. Failure to meet requirements, such as those outlined below, may result in rejection by the vehicle manufacturer:

 

Common Reasons for Rejection

  • Non-VAT registered or expired VAT number
  • No Limited company status (unless VAT registered)
  • Lack of registered premises (e.g., mobile mechanics in some cases)
  • Poor financial status (e.g., county court judgements)
  • Incorrect SIC code on Companies House (correct: 45200 – Maintenance and repair of motor vehicles)
  • Advertising prohibited services (e.g., DPF removal or remapping)
  • Use of manufacturer logos without permission

 

3. Payment of Accounts

All accounts must be paid by the 30th day of the month following the month of invoicing. Disputes relating to the quality of goods or services must be submitted in writing within two weeks of receipt.

In the event of late payment, Maverick reserves the right to suspend or cancel credit facilities and apply a service charge of 2% above the Bank Base Interest Rate at monthly intervals on overdue amounts until cleared. For online purchases, goods will not be shipped until payment has cleared.

 

4. Returns Policy

Faulty Goods

Goods are covered under warranty for manufacturing defects. Faulty goods must be reported within 14 days of discovering the fault and accompanied by proof of purchase. Maverick will repair, replace, or refund faulty goods as appropriate under UK law.

Non-Faulty Goods

Non-faulty goods will not be accepted for return unless authorised in writing by a Manager or Director. If authorised, the return will be subject to a 15% handling fee. Specially ordered, made-to-order, or customised goods cannot be returned unless proven faulty.

Conditions for Returns

  • Goods must be returned unused, in original packaging, and accompanied by relevant documentation.
  • Damage caused by misuse, incorrect installation, or mishandling is not covered under warranty.

 

5. Online and Distance Selling Regulations

Scope of Application

These terms apply to all contracts made online or through distance selling methods:

  • Business customers: Transactions are exempt from the Consumer Contracts Regulations unless explicitly stated.
  • Individual consumers: Additional rights under the Consumer Contracts Regulations apply.

Cancellation Rights (Individual Consumers Only)

If purchasing as an individual, you have the right to cancel your order within 14 days of receiving the goods. Exceptions include:

  • Customised or made-to-order goods
  • Sealed goods for hygiene purposes if unsealed
  • Digital content once accessed

To cancel, notify us in writing at sales@maverickdiagnostics.com or by post at our registered address. Goods must be returned at your expense within 14 days, in their original condition. Refunds will be processed within 14 days of receiving the returned goods.

 

6. Limit of Liability

Maverick’s liability is limited to the cost of the goods supplied. Maverick is not responsible for indirect, consequential, or economic losses, including loss of profit, contracts, or data. This limitation does not exclude liability for death or personal injury caused by negligence or fraudulent misrepresentation.

 

7. Subscriptions

  • Subscriptions are payable via debit or credit card securely processed by Barclays.
  • Payments are on a rolling monthly basis, with the payment date being the subscription inception date.
  • Subscriptions can be cancelled with 30 days’ notice.
  • Customers must update expired, lost, or stolen card details to maintain service continuity.

 

8. Damage or Shortage

Any damage or shortage must be reported within three days of delivery. Failure to do so will release Maverick from liability.

 

9. Fitness for Purpose

Goods are supplied for professional use only. The Customer is responsible for ensuring suitability for their intended purpose. Any guidance provided by Maverick is advisory and does not constitute a warranty of fitness.

 

10. Reservation of Title

Ownership of goods remains with Maverick until full payment is received. Until then, the Customer holds the goods as bailee and must keep them free of charges or encumbrances. Maverick reserves the right to repossess unpaid goods and may enter the Customer’s premises for this purpose.

 

11. Pricing

Prices are those ruling at the date of despatch. Quotations do not constitute an offer and are non-binding until an order is accepted.

 

12. Statutory Rights

These terms do not affect the statutory rights of individual consumers under UK law.

 

13. Governing Law

These terms and conditions are governed by the laws of England and Wales.

 

14. Data Protection

Maverick Diagnostics Ltd. processes personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR). 15. Warranties

Maverick Diagnostics Ltd. provides a limited warranty on goods supplied for manufacturing defects, subject to the terms outlined under the Returns Policy. This warranty does not cover damage caused by misuse, improper installation, or unauthorised modifications.

 

16. Customer Obligations

  • Customers must provide accurate and complete information during the order process.
  • Customers are responsible for ensuring the compatibility of goods with their specific needs and applications.
  • Customers must comply with manufacturer guidelines and regulations when using the goods.

 

17. Intellectual Property

All intellectual property rights in goods, documentation, and services provided by Maverick remain the property of Maverick or its licensors. Customers are not permitted to copy, modify, or distribute any materials without prior written consent.

 

18. Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through negotiation before pursuing legal action. Any unresolved disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

 

19. Force Majeure

Maverick Diagnostics Ltd. shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, strikes, or governmental actions.

 

20. Product Descriptions and Availability

Maverick Diagnostics Ltd. makes every effort to ensure the accuracy of product descriptions and specifications. However, we do not guarantee that products will be available at all times. Orders are subject to stock availability, and we reserve the right to cancel or modify orders if necessary.

 

21. Training and Support

Training and support services provided by Maverick Diagnostics Ltd. are offered as outlined in the specific service agreement. Maverick reserves the right to modify or withdraw training and support services at its discretion.

 

22. Updates to Terms and Conditions

Maverick Diagnostics Ltd. reserves the right to update these terms and conditions at any time. Customers will be notified of significant changes via email or website updates. Continued use of our services after changes are posted constitutes acceptance of the updated terms.

 

23. Export Control

Customers are responsible for ensuring compliance with all applicable export control laws and regulations when purchasing goods for use outside the United Kingdom.
